Heritage: the classification of a castle as a historical monument
ISMH or MH: What does it mean?
Within the framework of the protection of a historical monument, there are two options available to the owner (s): the classification or inclusion in the Supplementary Inventory of Historical Monuments.
1st measure: inclusion in the supplementary inventory
Buildings or parts of buildings which, without justifying an application for immediate classification, are of sufficient historical or architectural interest to make them desirable for preservation may be entered at the regional level on the Supplementary Inventory of Historic Monuments by the Prefects of region, on the proposal of the regional heritage and sites commission.
Rights and duties: the owner must inform the Ministry of Culture beforehand of the works envisaged, but the choice of the architect and the companies is left to his initiative. It also benefits from tax deductions in the case of realization of works and opening to the public. The surroundings are protected as for classified buildings. The State may grant subsidies for this work, which may range from 1 to 60% (very rare). On average, it will be 30%.
2nd measure: The ranking
Buildings or parts of buildings whose preservation presents a public interest from the historical and architectural point of view are classified at the national level by decision of the Minister for Culture on the proposal of the Superior Commission for Historic Monuments.
Rights and duties: a classified building may not be destroyed or moved, even in part, or be the subject of restoration, repair or modification work, if the competent authority has not given its consent (regional prefect or minister responsible for culture). The work must be carried out under the supervision of the administration of culture.
The area must be protected (within a radius of 500 m): any transformation within this perimeter must be subject to prior authorization by the architect of the Bâtiments de France.
In return for these constraints, the State provides technical assistance (the Chief Architect of Historical Monuments for major works or the Architect of Buildings in France for maintenance work) and financial support (up to 40 to 100 % of the amount of the work); the owners who carry out works and visit their monument at least forty days a year in summer enjoy tax benefits.
